Applications for new licences

After applications are received:
- an advertising period of 28 days will generally be required
- a conference may be held to hear any objections or submissions
- the applicant (if an individual) will be required to attend mandatory responsible management of licensed venues training unless they have completed the course within the last three years
Applications for new licences take at least 3–4 months to process, longer if there are public objections. Lodgement of the application is no guarantee that the licence will be granted.
Commercial Other
There are 5 types of Commercial Other licence which may be granted:
- subsidiary on-premises licence;
- subsidiary off-premises licence;
- bar licence;
- industrial canteen licence;
- producer/wholesaler licence
Trading hours
With the exception of the producer/wholesaler, all Commercial Other licences have the same ordinary trading hours as follows.
Liquor may be served at any time from Monday to Sunday, between the hours of 10:00 am and 12:00 midnight. If extended trading hours are required a separate application must be lodged for approved extended trading hours.
Applications to trade prior to 10:00am must demonstrate a community need for the extended hours.
Applications to trade beyond 12midnight must include either a full or standard Community impact statement, dependant on the hours applied for.

On Good Friday and Christmas Day, liquor may only be served during ordinary (not extended) hours, and only in conjunction with a meal prepared, served and intended to be eaten in an area ordinarily used for dining. On Anzac Day, this provision applies until 1:00 pm.
Subsidiary on-premises licence
Principal activity
The principal activity of a business conducted under a subsidiary on-premises licence is the provision of an activity, matter or service to which the sale of liquor for consumption on the licensed premises is a subsidiary aspect.
Types of businesses that will be licensed under subsidiary on-premises licence:
vessels, indoor sporting centres, theatres, amusement parks, function centres, training institutions, cinemas.
If the principal activity of a business includes any of the following, specific conditions will apply:
- provision of entertainment e.g. night club, cabaret
- provision of meals prepared, and served to be eaten on the premises e.g. restaurants/cafes
- provision of accommodation e.g. motel, resort
Trading Conditions
Liquor may be sold during ordinary trading hours or approved extended trading hours in association with an activity, matter or service provided on the licensed premises -
-
for consumption on the licensed premises, and
-
if stated in the licence, for consumption off the licensed premises
Additional privileges
A Commercial Other (subsidiary on-premises) licence may also include any of the following privileges with the approval of the chief executive. Separate applications are required in each instance:
- approval for extended hours before 10:00am or after 12midnight

Subsidiary off-premises licence
Principal activity
The principal activity of a business conducted under a subsidiary off-premises licence is the provision of an activity, matter or service to which the sale of liquor for consumption off the licensed premises is a subsidiary aspect.
Types of businesses that will be licensed under subsidiary off-premises licence:
Caterers, gift baskets, florists.
Businesses that will NOT be licensed include premises used primarily as a supermarket and premises used primarily for hiring out of party equipment.
Trading Conditions
Liquor may be sold for consumption off the premises if the amount of each sale is not more than
- the amount stated by the chief executive in the licence or
- in any other case, 2L.
Additional privileges
A Commercial Other (subsidiary off-premises) licence may also include any of the following privileges with the approval of the chief executive. Separate applications are required in each instance:
- approval for extended hours before 10:00am or after 12midnight

Bar licence
Principal activity
The principal activity of a business conducted under a bar licence is the sale of liquor on the licensed premises having the capacity to seat not more than 60 patrons at any one time.
Trading Conditions
Liquor may be sold for consumption on the licensed premises during ordinary trading hours or approved extended trading hours.
Additional privileges
A Commercial Other (Bar) licence may also include any of the following privileges with the approval of the chief executive. Separate applications are required in each instance:
- approval for extended hours before 10:00am or after 12midnight

Industrial canteen licence
Principal activity
The principal activity of a business conducted under an industrial canteen licence is the sale of liquor on the licensed premises located within a remote industrial locality.
A remote industrial locality is defined as being a location which has no permanent residential population and mining, rail or road construction activities are happening.
Trading Conditions
Liquor may be sold to a person working at the remote industrial location where the premises are located or a member of the family or a guest of the abovementioned person. The liquor may be sold to the abovementioned persons on the licensed premises for consumption on or off the premises.
Additional privileges
A Commercial Other (industrial canteen) licence may also apply for approval of extended hours before 10:00am or after 12midnight.

Producer/wholesaler licence
Principal activity
The principal activity of a business conducted under a producer/wholesaler licence is either or both of the following:
- production and wholesale sale on the licensed premises of liquor made on the premises
- wholesale sale of liquor on the licensed premises.
Trading conditions
If the Licensee is a producer of liquor and the liquor is produced or made on the premises, liquor can be sold on the licensed premises for consumption on or off the premises during ordinary trading hours or approved extended trading hours.
If the Licensee is a wholesale supplier of liquor, then liquor can be sold on the licensed premises for consumption off the premises during ordinary trading hours.
Trading hours - wholesaler
Liquor may be sold during the same trading hours as a non-exempt shop under the Trading (Allowable Hours) Act 1990.
Trading hours - producer
Liquor may be served on any day on which the premises may be open under the Trading (Allowable Hours) Act 1990, between the hours of 10:00am to 12midnight, with a meal or as a souvenir of a visit.
If extended trading hours are required a separate application must be lodged.
Trading conditions
Liquor may be sold wholesale to:
- a licensee or permit holder
- persons exempted by the Liquor Act 1992 from obtaining a licence and/or
- persons licensed or exempted by another state or territory or the Commonwealth.
Licensees who are producers may also sell liquor to:
- patrons with a meal that has been prepared on the premises for consumption on the premises and/or
- a visitor, if the sale is a souvenir of the visit
Community club licence
Principal activity
This licence may only be granted to a non-proprietary club. The Liquor Act 1992 defines a non-proprietary club as 'an association of persons under whose constitution any income, profits and assets are used only in promotion of its objects, and not for distribution to its members'.
Community club licences may only be held by incorporated associations, or unincorporated associations with an individual to hold the licence on their behalf. Upon incorporation, the licence must be transferred from the individual to the club within three months.
Trading hours
Liquor may be sold at any time from Monday to Sunday, between the hours of 10am and 12midnight. If extended trading hours are required a separate application for approved extended trading hours must be lodged.

The holder of a community club licence may apply to allow trading between 7am to 9am if the sport of the club is one prescribed in a Regulation (lawn bowls or golf) or if community need can be demonstrated.
An application for trading between 9am and 10am is also available to this licence if a community need can be demonstrated.
On Good Friday and Christmas Day, liquor may only be served during ordinary (not extended) hours, and only in conjunction with a meal, in an area ordinarily used for dining. On Anzac Day, this provision applies until 1pm.
Trading conditions
Liquor may be sold for consumption on or off the premises to:
- members of the club
- members of clubs with formal reciprocal rights or
- visitors authorised by the management committee playing a sport that is part of the club's business, including teams and officials, for the day on which the sport is played only.
Liquor may be sold for consumption on the premises only to:
- a guest of a member
- a guest of a member of a club with formal reciprocal rights
- an applicant for membership for 30 days after receipt of application
- an interstate or overseas visitor
- a visitor who resides at least 15 km from the club or
- a person attending a function on the premises.
No takeaway sales are permitted to people in these categories
A register of members, and a register of all visitors to the club (except minors and visiting players) must be maintained, and be available for inspection at the premises at any time.
Additional privileges
The chief executive may also approve any of the following privileges for a club licence. Separate applications are required in each instance:
- approval for extended hours before 10am or after 12midnight
- for sporting clubs only, approval to sell liquor on the club's sporting field; or
- for golf clubs only, approval to operate a mobile refreshment vehicle on the course
Licensed clubs may also apply to OLGR for a licence to operate gaming machines
Community Other licence
Principal activity
This licence may only be granted to a non-proprietary club which trades no more than 25 hours per week. The Liquor Act 1992 defines a non-proprietary club as 'an association of persons under whose constitution any income, profits and assets are used only in promotion of its objects, and not for distribution to its members'.
Community other licences may only be held by incorporated associations, or unincorporated associations with an individual to hold the licence on their behalf. Upon incorporation, the licence must be transferred from the individual to the club within three months.
Trading hours
Liquor may be sold for a maximum of 25 hours per week from Monday to Sunday, between the hours of 10am and 12midnight. These hours must be advised at the time of application and will be endorsed on the licence.
On Good Friday and Christmas Day, liquor may only be served during the approved trading hours and only in conjunction with a meal, in an area ordinarily used for dining. On Anzac Day, this provision applies until 1pm.
Trading conditions
Liquor may be sold for consumption on the premises to:
- members of the club
- members of clubs with formal reciprocal rights or
- a guest of a member
- a guest of a member of a club with formal reciprocal rights.
This licence does not permit takeaway sales or gaming
A register of members and a register of all visitors to the club (except minors and visiting players) must be maintained and be available for inspection at the premises at any time.
Commercial Special facility licence
Principal activity
A commercial special facility licence allows liquor to be served in association with the provision of one of the following facilities:
- a casino or
- an airport or
- a convention centre
- another facility which makes, or is likely to make a significant contribution to the tourism development of the state. This does not include sporting facilities.
Trading hours
Liquor may be served at any time from Monday to Sunday, between the hours of 10am and 12midnight. If extended trading hours are required a separate application must be lodged for approved extended trading hours.
Applications to trade prior to 10am must demonstrate a community need for the extended hours.
Applications to trade beyond 12midnight must include either a full or standard Community impact statement, dependant on the hours applied for.

Casinos and airports which have approval to trade 24 hours prior to 1 January 2009 will continue to have these trading hours.
On Good Friday and Christmas Day, liquor may only be served during ordinary (not extended) hours, and only in conjunction with a meal prepared, served and intended to be eaten in an area ordinarily used for dining. On Anzac Day, this provision applies until 1pm.
Trading conditions
Trading conditions will be determined having regard to the nature of the business being conducted, and will be endorsed on the licence document.
The licence document will also designate defined liquor consumption areas. Generally, liquor may be served:
- to the general public for consumption on the premises during the hours specified in the licence or
- to the general public for consumption off the premises if the licence so specifies.
Additional privileges
A commercial special facility licence may also include any of the following privileges with the approval of the Chief Executive. Separate applications are required in each instance:
- approval for extended hours before 10am or after 12midnight
- approval for entertainment.
